I Application
These General Terms and Conditions of Sale (hereinafter: “GTC”) apply to sales concluded by Hotel Sixteen (hereinafter: “the Company”) with the Client.
They cancel and replace any previous version that may have been published online and/or accepted by the Client.
These GTC apply to any use of the Site, in particular to the marketing via the Internet and by telephone of all the services offered on the Site by JFM Investissement.
It is therefore imperative that the Client carefully read the GTC made available to them. The Client is advised to download and/or print a copy at the time of the order, as these GTC may be subject to change. However, such modifications will not apply to orders placed prior to their implementation.
The GTC may be supplemented by special terms of sale appearing in the description of the service, as well as by the terms of sale of service providers, accessible either on their websites or on-site.
II Capacity
The Client acknowledges that they have the legal capacity to contract, meaning they are of legal age and not under guardianship or curatorship.
The Client also declares that they are using the Site in accordance with these GTC, on their own behalf and on behalf of all beneficiaries of the services ordered on the Site, for whom they act as agent (hereinafter: the “Beneficiaries”), and to whom these GTC will also apply.
The Client is financially responsible for use of the Site both on their own behalf and on behalf of the Beneficiaries, unless they can prove fraudulent use that does not result from their fault or negligence.
The Client guarantees the truthfulness and accuracy of the information provided by them on their own behalf and on behalf of all Beneficiaries using their data on the Site.
The Company reserves the right, at any time, not to contract with a Client making fraudulent use of the Site or violating these GTC. In this respect, reference is made to Article 313-1 of the French Penal Code:
“Fraud consists of using a false name or false status, or by abusing a true status, or by using fraudulent maneuvers to deceive a natural or legal person and thus cause them, to their detriment or to the detriment of a third party, to hand over funds, valuables, or any property, to provide a service, or to consent to an act creating an obligation or release. Fraud is punishable by five years’ imprisonment and a fine of €375,000.”
III Right of Withdrawal
Pursuant to Article L 121-21-8 of the French Consumer Code, the services offered on the Site by the Company are not subject to the right of withdrawal provided for in Articles L. 121-21 et seq. of the French Consumer Code on distance selling.
Consequently, the services ordered on the Site are subject only to the cancellation and modification conditions set out in these GTC, and the Client cannot invoke the right of withdrawal.
IV Prices
Prices are indicated in Euros. VAT is included in the rates. Any change in the applicable rate, or any modification or creation of new legal taxes by the competent authorities, will automatically be reflected in the prices indicated on the billing date.
Rates are quoted per room for the number of people indicated and for the selected period.
Prices include only the services expressly mentioned in the reservation. Additional services provided by the hotel during the stay and, if applicable, the tourist tax, will be added to the reservation price.
Prices listed on the Site may be changed at any time by the Hotel without prior notice. Only the price indicated in the reservation confirmation from the Company is contractual.
No reservation made prior to the implementation of a promotional offer will be subject to reimbursement, even partial.
V Online Orders
When placing an order, the Client must:
– Complete the identification form by providing all requested contact details,
– Complete the online order form by entering all references of chosen products or services,
– Validate their order after checking it,
– Make payment under the specified conditions and confirm the order and payment in case of an advance purchase plan, or provide the Company with banking details in case of a flexible plan.
– Any reservation of more than 5 rooms may be subject to special conditions and additional fees. Please contact the hotel at +33 (0)1 40 92 98 18.
Order confirmation constitutes acceptance of these terms of sale, acknowledgment of full knowledge thereof, and waiver of the Client’s own purchase terms or other conditions.
All data provided and the recorded confirmation shall constitute proof of the transaction. Confirmation constitutes signature and acceptance of the operations carried out.
The Company will send the Client confirmation of the recorded order by email and/or SMS.
The reservation is only firm and final upon receipt of confirmation sent to the Client by the Company.
The rates, terms, and conditions of a reservation are intended for the sale of hotel rooms in accordance with their primary purpose (accommodation). The hotel reserves the right to modify rates, terms, and conditions, or to cancel the reservation if rooms are used for other purposes such as photo shoots, filming, showrooms, or interviews.
VI Online Payment Terms
Depending on the type of reservation, payment may be required in full at the time of booking (advance purchase) or during the Client’s stay at the Hotel (flexible plan).
In all cases, to guarantee the reservation, the Client must provide credit card details through a secure system.
If payment is made at the time of booking, the Client’s card is charged for the full amount of the stay securely, and the invoice is provided on the Client’s departure from the Hotel.
The credit card used for the reservation must be presented upon arrival by its holder. Otherwise, a new card will be requested for payment at check-in.
If a third party covers the stay, the hotel will require documents to ensure transaction security. The hotel reserves the right to pre-authorize the Client’s card at any time before arrival.
VII Reservation Modification and/or Cancellation
Cancellations or modifications may be allowed depending on the plan selected.
– For flexible plans: requests must be made no later than the day before arrival at 6:00 pm.
– For advance purchase plans: no modification or cancellation is accepted, and the full amount is retained by the Hotel.
In case of no-show without cancellation:
– The full amount is charged for advance purchase reservations,
– The first night is charged for flexible plan reservations.
For stays of 2 nights or more, if the Client does not show up on the first day, the Hotel is not required to keep the room for the remaining nights.
VIII Relocation
In case of unavailability of the Hotel or force majeure, the Client may be accommodated in a hotel of equivalent or higher category, with similar services. The transfer will be at the Hotel’s expense, without any additional compensation due.
IX Additional Services – Packages
Orders for additional services and/or packages must be placed at the same time as the reservation of a stay. They may only be used during the Client’s stay and may only be modified or canceled under the conditions of Article VII.
X Force Majeure
Force majeure refers to any event beyond the parties’ control that is both unforeseeable and insurmountable, preventing either the Client or the Hotel from fulfilling contractual obligations (e.g., insurrection, riots, prohibitions by government authorities).
Force majeure suspends the parties’ obligations, and each bears the resulting costs. Clients remain responsible for extra expenses incurred to continue travel due to such events.
XI Complaints
Any complaint must be addressed within 15 days after departure to:

After contacting the Reservation Department, and in the absence of a satisfactory response within 30 days, the Client may refer the matter to the Tourism and Travel Mediator:

XII Data Protection
In accordance with French Law 78-17 (Data Protection Act), bookings are subject to computerized processing of personal data. Clients have a right of access and rectification of their data by contacting: JFM INVESTISSEMENT, 16 Place Jean Jaurès, 92120 Montrouge, France.
Such data will not be shared with third parties.
The Company provides Wi-Fi access. The Client agrees not to use it for the reproduction, distribution, or communication of works protected by copyright without authorization.
The Hotel is equipped with a video surveillance system in common areas.
XIII Liability
The Company accepts no liability for theft, loss, or damage to Clients’ belongings during their stay.
The Client is responsible for any damage, deterioration, or vandalism caused during their stay, whether by themselves, their guests, or staff under their responsibility. The Hotel reserves the right to require the Client to leave the premises without compensation or refund, and to pay for damages.
The Company is bound only by an obligation of means in online sales. It is not liable for damages resulting from Internet use such as data loss, intrusion, viruses, or service disruption.
XIV Governing Law
These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and formal rules. Disputes fall under the exclusive jurisdiction of French courts.
